Client Care Letter

This Client Care Letter is provided to you in connection with your mortgage switch and should be read together with our Letter of Engagement and our Terms and Conditions of Business (Mortgage Switch). These documents explain how we will act for you, the standards you can expect, and important regulatory information.

1. Our Firm and Regulation

Gary Irwin Solicitors is a firm of solicitors practising in Ireland. We are regulated by the Legal Services Regulatory Authority (LSRA) and all solicitors acting in this matter hold current practising certificates.

2. Nature of Our Relationship with You

When you instruct us, a solicitor–client relationship is created between you and Gary Irwin Solicitors. We owe you professional duties including duties of independence, confidentiality, competence and acting in your best interests.

QuickMove ("QM") is a software platform used to facilitate communication, document exchange and workflow management. QM does not provide legal services or legal advice. Your use of the QM platform does not affect your legal rights or the professional duties owed to you by this firm.

3. Scope of Services

Our services are limited to the legal work involved in switching your existing mortgage to a new lender, as set out in our Letter of Engagement. We do not provide financial, tax or investment advice and we do not advise on the commercial suitability of any loan product.

4. Legal Costs Information

Information regarding legal costs has been provided to you through the quotation process prior to engagement. We will comply with our obligations under the Legal Services Regulation Act 2015 to notify you if circumstances arise which are likely to result in a significant increase in legal costs.

You are responsible for all agreed legal fees, outlays and applicable taxes.

5. Anti-Money Laundering and Identity

We are required by law to verify your identity and, where relevant, the source of funds involved in the transaction. We cannot proceed with your matter unless these requirements are satisfied. Failure to provide requested documentation may delay or prevent completion of your mortgage switch.

6. Confidentiality and Data Protection

We treat all client information as confidential, subject to our legal and regulatory obligations. We process personal data in accordance with applicable data protection legislation. Further details are set out in our Data Protection and Privacy Notice, which is available on request.

We may use secure electronic systems, including third-party service providers, to store and process information as part of delivering legal services.

7. Communication

Unless you instruct otherwise, we may communicate with you by email, telephone, post and through secure digital platforms. While electronic communication is efficient, it may not be completely secure. If you have any concerns, please let us know.

8. Conflicts of Interest

We conduct conflict checks before accepting instructions. If a conflict of interest arises during the course of your matter which prevents us from continuing to act, we will inform you and, where appropriate, assist with transferring your file to another solicitor.

9. Complaints Procedure

We aim to provide a professional and high-quality service at all times. If you are dissatisfied with any aspect of our service, you should raise the matter in the first instance with the solicitor responsible for your file.

If the matter cannot be resolved internally, you may make a complaint to the Legal Services Regulatory Authority in accordance with its procedures.

10. Professional Indemnity Insurance

We maintain professional indemnity insurance in accordance with our regulatory obligations.

11. Cooling-Off Information

In certain circumstances, consumer protection legislation may provide you with a limited right to cancel a contract for legal services. If applicable, this does not affect your liability for work properly carried out prior to cancellation.

By accepting the terms and conditions of Business and agreeing to the letter of engagement you are waiving this cooling off period.

12. Termination of Instructions

You may terminate your instructions at any time. We may cease acting where permitted by law or regulation, including for non-payment of fees or where continuing to act would breach our professional obligations. The terms and conditions of business deal with the liability of legal fees.
