Letter of Engagement

This Letter of Engagement sets out the basis upon which Gary Irwin Solicitors will provide legal services to you in relation to your mortgage switch. It should be read together with our Client Care Letter and our Terms and Conditions of Business (Mortgage Switch), which together govern the solicitor and client relationship between you and this firm.

1. Our Role and Scope of Work

You are instructing Gary Irwin Solicitors to provide legal services in connection with the switching of your existing mortgage to a new lender. Our role is limited to the legal work customarily undertaken by solicitors in Ireland in a mortgage switching transaction, including (where applicable):

  • reviewing the loan offer and related security documentation;
  • carrying out title investigations appropriate to a mortgage switch;
  • dealing with redemption of the existing mortgage;
  • attending to the drawdown of the new mortgage;
  • registering the new mortgage and discharge of the existing mortgage;
  • reporting to the new lender in accordance with its requirements.

Our retainer is strictly limited to a mortgage switch. It does not extend to a sale or purchase of property, refinancing involving additional borrowing beyond the scope disclosed at quotation stage, tax advice, financial advice, or any other legal services unless expressly agreed in writing.

2. Relationship with the QuickMove Platform

You have engaged with QuickMove ("QM"), which is a software platform designed to facilitate digital workflows, communications and document exchange.

For the avoidance of doubt:

  • QM does not provide legal services or legal advice;
  • QM is not a firm of solicitors and is not regulated as such;
  • all legal services in your mortgage switch are provided exclusively by Gary Irwin Solicitors.

Your use of the QM platform does not affect your freedom to choose your solicitor and does not alter the solicitor-client relationship created by this Letter of Engagement.

3. Legal Fees and Prior Quote

The legal fee applicable to your mortgage switch was generated and accepted by you via the QM platform prior to this engagement.

That quote, and the terms governing it, form part of the contractual arrangements between you and the relevant parties and are incorporated by reference into our Terms and Conditions of Business (Mortgage Switch).

This Letter of Engagement does not restate those fees. However, additional fees and outlays may arise in circumstances outside the scope assumed at quotation stage. Where this occurs, you will be notified in accordance with applicable legal costs legislation.

4. Regulatory Status

Gary Irwin Solicitors is a firm of solicitors practising in Ireland and is regulated by the Legal Services Regulatory Authority. All solicitors providing services to you in this matter hold current practising certificates.

5. Commencement of Services

We will not commence substantive legal work until:

  • you have confirmed your instructions to proceed;
  • you have accepted this Letter of Engagement and the accompanying documents;
  • all regulatory requirements, including anti-money laundering checks, have been satisfied.

Nothing in this letter obliges us to act where doing so would place us in breach of our professional or regulatory obligations.

6. Limitation of Liability

Our liability to you arising out of this engagement, whether in contract, tort, statute or otherwise, shall be limited in accordance with the limitation of liability provisions set out in our Terms and Conditions of Business (Mortgage Switch). Nothing limits liability where such limitation is not permitted by law.

7. Cooling-Off Information

Where applicable under consumer protection legislation, you may have a right to cancel your contract for legal services within a prescribed period. Further information is contained in our Client Care Letter.

8. Acceptance

Please confirm your agreement to this Letter of Engagement and your wish for us to proceed by signing and returning a copy of this letter or by confirming acceptance electronically.
